The importance of this point is that the real complaint by homosexual men is that they are not allowed to give expression to their sexual desires, whereas heterosexual men are. In so far as that is discriminationand, of course it is-it is not the sort of discrimination which is struck down by s 23. The constitution goes on, in s 23(5)(b), to make the obvious qualification that a law may be discriminatory 'to the extent that it takes due account of physiological differences between persons of different gender'.
Otherwise we might have the ridiculous situation that a rapist could argue 'the law against rape is unconstitutional because only men can be rapists'. Or a woman could argue 'the law against infanticide [Ch 9:12] is discriminatory on the ground of gender because only women who have just given birth can be punished under that Act'. (I ignore the fact that a woman may technically be found guilty of rape as an accomplice, or a man of infanticide on the same basis.)
'Ah' say the proponents of the other view triumphantly, 'but we do not penalise men who perform this act with women. Nor do we penalise the women involved as passive partners. That is where the discrimination lies'. I confess that I regard this argument as a kind of 'chop-logic', entirely lacking in common sense and real substance. Of course, it is technically correct. But realistically, and without going into sordid detail, how often does it happen that men penetrate women per anum? How often, if it does happen, is it the result of a drunken mistake? Or an excess of sexual experimentation in an otherwise acceptable relationship? And, most importantly, how can it be proved? I refrain from further analysis.
In my view, the law has properly decided that it is unrealistic to try to penalise such conduct between a man and a woman. I do not accept that that fact should lead us to the conclusion that it is discriminating to penalise it when it is between two men. The real discrimination, as I have said earlier, is against homosexual men in favour of heterosexual men-and that is not discrimination on the ground of gender. [...] This kind of discrimination is not dealt with in the constitution. It is thus not outlawed by the constitution.“
Většina Nejvyššího soudu Zimbabwe dekriminalizaci sodomie soudcovskou cestou odmítla. I když toto rozhodnutí asi západní liberální intelektuály příliš neuspokojí, je na něm sympatické to, že soud otevřeně přiznává, že je konzervativní. Stejně tak potvrzuje, že bude respektovat většinový názor společnosti a odmítá prosazovat společenskou proměnu soudní cestou ve stylu Spojených států amerických.
Druhým příkladem mile košilatého rozhodnutí je rozsudek Nejvyššího soudu Spojených států amerických ve věci United States, Et Al. V. Playboy Entertainment Group, Inc. 529 U.S. 803. Tato kauza se týkala oprávnění federální vlády regulovat vysílací časy pro televizní kanály přenášející pornografii, případně vyžadovat rušení signálu v době, kdy mohou být u televize děti. Jedna z posuzovaných otázek byla, zda vysílání Playboye spadá pod svobodu projevu a tím pádem pod (zdánlivě absolutní) ochranu Prvního dodatku k Ústavě USA. Soudce A. Scalia se snažil ve svém odlišném stanovisku zdůraznit, že to, co na svých kanálech Playboy šíří, by se rozhodně ústavní ochrany svobody projevu těšit nemělo:
„Playboy itself illustrates the type of business ß 505 is designed to reach. Playboy provides, through its networks -- Playboy Television, AdulTVision, Adam & Eve, and Spice -- [*834] "virtually 100% sexually explicit adult programming." 30 F. Supp. 2d 702, 707 (Del. 1998). For example, on its Spice network, Playboy describes its own programming as depicting such activities as "female masturbation/external," "girl/girl sex," and "oral sex/cunnilingus." 1 Record, Exh. 73, p. TWC00132. As one would expect, given this content, Playboy advertises accordingly, with calls to "Enjoy the sexiest, hottest adult movies in the privacy of your own home." 6 id., Exh. 136, p. 2P009732.
An example of the promotion for a particular movie is as follows: "Little miss country girls are aching for a quick roll in the hay! Watch southern hospitality pull out all the stops as these ravin' nymphos tear down the barn and light up the big country sky." 7 id., Exh. 226, p. 2P009187. One may doubt whether -- or marvel that -- this sort of embarrassingly juvenile promotion really attracts what Playboy assures us is an "adult" audience. But it is certainly marketing sex.“
