Ostatně to je potvrzeno tím, že na soud jsou nominováni jen extra soudci z nejvyšších soudů s výborným vzděláním a výsledky. Politické kritérium je ale přeci samozřejmost, když jde o tak politickou funkci (viz např. boj o Obamacare atd.).
